As
a writer, this is one of the most important documents you will ever
sign. While publishing contracts differ from one publisher to another,
there are several points that a publishing contract must deal with:
1. Copyright ownership.
2. Author’s obligations—particularly
if the Work also includes works of other people e.g. translator,
photographer, illustrator etc.
3. Publisher’s obligations.
4. Terrorities covered by the
contract.
5. Deadlines for submission of
manuscript, graphics and other materials required, care and return
of submitted materials.
6. Definition of terms used in
the contract, including the duration of the contract (hence date
of contract is vital).
7. Money—the crux of the contract. Royalty
rates, advance, payment schedule, financial obligations in the event
of any legal proceedings.
8. Termination of contract—what happens when
the contract expires, other means of terminating the contract besides
expiration,
9. Jurisdiction of the contract—which country’s
laws are applicable in the event of arbitration, mediation or any
other legal proceedings.
